Cable Huston Secures Appellate Victory for Stewart Title in Longstanding Tax Dispute

Congratulations to Cable Huston client Stewart Title Guaranty Co. on a recent victory before the Oregon Court of Appeals in a complex tax dispute with the State of Oregon Department of Consumer and Business Services. On July 1, 2015, the Oregon Court of Appeals affirmed a judgment by the trial court in Stewart Title’s favor invalidating the State’s attempt to assess Stewart Title’s so-called “retaliatory taxes” based on portions of the premiums paid by its customers which were retained by Stewart Title’s local agents in Oregon. The recent appellate victory ends an over 10-year dispute between Stewart Title and the State of Oregon concerning the payment of retaliatory taxes.
Cable Huston partner G. Kevin Kiely acted as trial counsel, and Jon W. Monson acted as appellate counsel and argued the case on appeal. The appeal is captioned Stewart Title Guaranty Co. v.
